Skin Cancer

Experience and Expertise Fighting on Behalf of Misdiagnosed Skin Cancer Victims in Rochester, Syracuse and all of Upstate New York

Each year, tens of thousands of people in the United are diagnosed with skin cancer — and numbers have risen consistently over the past few decades. Skin cancer affects more people in the United States than any other form of cancer. Despite its prevalence, however, doctors and other health care providers continue to neglect symptoms and treatment.

At DeFrancisco & Falgiatano Personal Injury Lawyers, we have helped many people who have suffered physical harm or lost loved ones to skin cancer who could have been diagnosed sooner. We encourage you to contact us to learn how we can help you protect your rights if you or a loved one is a victim of skin cancer misdiagnosis.

Early Detection and Diagnosis of Skin Cancer

If your doctor believes that you might have skin cancer, he or she will likely perform a biopsy to gather more information. Your doctor may recommend you see an oncologist if there is cancer, particularly if it has begun to spread.

As with most other forms of cancer, early detection can make a tremendous difference. The earlier cancer is diagnosed, the higher the patient's chances of getting better.

The ABCDE rule is a guide to the usual signs of melanoma:

  • A is asymmetry: The lesion, birthmark or mole is asymmetrical, with halves that do not mirror each other.
  • B is border: The edges are not smooth but ragged, blurred or notched.
  • C is color: The color is inconsistent, varying in different spots. The color may include shades of brown or black or sometimes have patches of pink, red, white or blue.
  • D is diameter: The skin spot is larger than 6 millimeters across (about ¼ inch).
  • E is evolving: The skin lesion is changing in size, shape or color.
  • Other warning signs are sores that do not heal, redness beyond the border of a new swelling, a change in the sensation of a lesion (itchiness, tenderness or pain), or a change in the surface of a mole.
How Does Failure to Diagnose Cancer Occur?

There are many ways a doctor can negligently fail to make an accurate diagnosis of skin cancer:

  • Failure to recommend proper screening tests
  • Failure to identify symptoms associated with skin cancer
  • Failure to perform a biopsy when appropriate
  • Improper administration of screening tests
  • Errors by the testing laboratory

Living with a cancer diagnosis is never easy. Living with late-stage cancer that could have been prevented is particularly devastating. If a doctor's misdiagnosis is the cause of cancer progression that affected you or a loved one, you may be angry, hurt or confused about your options. While nothing can turn back time and undo the damage, our lawyers can help you hold the responsible parties accountable for their negligence.

In doing so, our medical malpractice lawyers will pursue every dollar of compensation available to you under the law so you can focus on living as comfortably as possible and taking care of your loved ones. Our lawyers have extensive experience handling medical malpractice cases involving the failure to timely diagnose and treat skin cancer.
