This was illustrated recently in a New York <a href=\"https:\/\/www.nycourts.gov\/courts\/ad2\/Handdowns\/2022\/Decisions\/D70724.pdf\" target=\"_blank\" rel=\"noopener\">matter<\/a> in which the court dismissed the plaintiff\u2019s claims on the grounds that she could not establish that her harm arose out of the defendant\u2019s negligence. She then filed a medical malpractice lawsuit against the defendant. The defendant moved for summary judgment, and the trial court granted his motion.
